Navigating LCA Worksite Postings for Remote and Hybrid Full-Stack Teams

Remote work did not remove the posting requirement — it multiplied the number of places where the notice has to exist.

The Labor Condition Application assumes a place of employment. Distributed full-stack teams complicate that assumption without eliminating it, and the practical result is that hybrid arrangements demand more posting discipline than fully on-site ones, not less.

Defining the Place of Employment

The place of employment is where the worker actually performs the work. A home office is a worksite. A client office visited two days per week is a worksite. Short-term placements may fall under limited exceptions, but the default assumption should be that each regular location requires coverage.

Locations within normal commuting distance of a listed worksite generally do not require a new application, which is why the area of intended employment must be defined deliberately rather than copied from a previous filing.

Notice Requirements in Distributed Teams

Notice must be provided at each place of employment, either by hard-copy posting in two conspicuous locations or by electronic notification to similarly employed workers. For distributed teams, electronic notice through an intranet page or a direct notification to the affected engineering group is usually the only workable method.

Retain proof: a screenshot of the intranet notice with dates, or the distribution record for the notification. The obligation is to demonstrate notice occurred within the required window, and an undated artifact demonstrates nothing.

Public Access File Hygiene

The public access file must be assembled within one working day of filing and contain the certified application, the wage rate, the prevailing wage determination and its source, the actual wage memorandum, and proof of notice. Files should be retained for the required period after the employment ends.

For staffing organizations running many concurrent applications, per-consultant folder templates and a single owner for file completeness prevent the drift that audits find immediately.

Handling Mid-Engagement Relocation

When a hybrid consultant changes client sites or relocates outside the area of intended employment, a new application and new notice are required before the move. Building that check into the account-change workflow avoids the most common violation in distributed staffing.

Benching, wage obligations and the duty to pay the required wage during non-productive time also continue regardless of where the consultant sits.
