H-1B Transfer Timelines: Starting Work on USCIS Receipt Notice

Portability lets a transferring engineer start on the receipt notice — but only when status has been maintained and the petition was properly filed.

H-1B portability is one of the most useful provisions in employment-based immigration and one of the most frequently misapplied. A transferring full-stack engineer can begin work for a new employer once a non-frivolous petition is filed on their behalf, provided they were lawfully admitted and have not engaged in unauthorized employment.

What the Receipt Notice Does and Does Not Do

The receipt notice evidences that the petition was filed and accepted for processing. It authorizes employment to begin, but it does not guarantee approval and does not extend status by itself if the underlying period is expiring. Onboarding should record the receipt number and the filing date, both of which appear in the I-9 supporting documentation.

Employment must begin no earlier than the filing date, and the role must match the role described in the petition.

Evidence of Maintained Status

Portability depends on prior status maintenance. Practically, this means recent pay records from the previous employer covering the period up to separation, prior approval notices, and the most recent arrival record. Gaps in pay — benched time without wages — are the most common weakness and should be identified before the transfer is filed rather than after a request for evidence arrives.

Where a gap exists, disclosing and explaining it in the filing is materially better than leaving it to be discovered.

Timing, Premium Processing and Delivery Planning

Standard processing can take months, and the engineer is working during that entire period. Premium processing compresses adjudication to a short statutory window and is usually worth the fee when the placement is client-facing, when the engineer will need to travel, or when an extension is bundled with the transfer.

Delivery planning should assume the engineer is fully productive from day one and that immigration status changes will not interrupt the sprint. Travel plans, however, should be deferred until approval where possible.

Planning for a Denial

If the transfer is denied, work authorization with the new employer ends. Contingency options include a refiled petition addressing the deficiency, a return to a prior employer where the earlier petition remains valid, or a change of status. Documenting the fallback at offer stage protects both the engineer and the client engagement.

The organizational habit that matters most is treating the receipt notice as a start signal and the approval notice as the closure of the file — never conflating the two.
